Legal Bases

The Federal Act on the Establishment and Organization of the Federal Bureau of Anti-Corruption (BAK-G) (258,6 KB), which entered into force on 1 January 2010 and was last amended by BGBl. (Federal Law Gazette) I 107/2023, provides the legal basis for the Federal Bureau of Anti-Corruption (BAK).

By approving this federal act, Austria meets international requirements and obligations concerning the setting-up of independent national anti-corruption bodies. In particular, the United Nations Convention against Corruption (UNCAC), in its articles 6 and 36, calls upon the States Parties to create such authorities. The BAK is thus both a preventive body in accordance with article 6 and a law enforcement institution in accordance with article 36 of the UNCAC.
